U/s.82 Cr.P.C.

1.The above case stands posted for the appearance of the accused. The accused in the above case failed to appear before this Honourable Court. Hence this Honourable Court issued Non-bailable warrant against the above accused and the same is pending for execution.
2. The Complainant took steps through Registered Post and the same had been returned unserved. Subsequently, the Complainant took steps to serve summons to the accused in person but the same had also been not possible, since he was not in the said address. In connection with the same, the Complainant had obtained the Village Administrative Officer’s certificate and the same was submitted along with the petition filed under section 87 Cr.P.C., in this Honourable Court on 11.05.2004.
3. The police authorities concerned also took steps டு serve the summons to the accused and the same ended in futile. Hence the Police Officers concerned also had obtained Village Administrative Officer’s certificate and submitted before this Honourable Court.
4. In the above mentioned circumstances, it is highly necessary to take further legal steps to summon the accused through proclamation and attachment requiring him to appear at a specified place and at a specified time not less than thirty days from the date of publishing such proclamation according to prescribed procedures.
5. More over it is also submitted that if this Honourable Court thinks fit, direct a copy of the proclamation to be published in a daily news paper circulating in the place in which such person ordinarily resides.
Hence, it is most humbly prayed that this Honourable Court be pleased to allow this petition and thus render justice.

Written argument notes on behalf of the Complainant under Sec. 314 Cr.P.C.

The facts of the Prosecution case is that the Complainant Food Inspector has taken “Raja’s Turmeric Powder”, as food sample from the accused A-1,Thiru. . . . . . . . who was selling the “Raja’s Turmeric Powder” at . . . .,Trichendur Road, Palayamcottai following the Prevention of Food Adulteration Act & Rules and sent it for analysis. A-2, Thiru.. . . . . . . is the Proprietor of the . . . . . . . . . . . . . .. which manufactured the “Raja’s Turmeric Powder”. On the basis of the Public Analyst’s report, the accused was charged under Sec. 7(i), 7(ii) , 16(1) (a) (i) r/w 2(ia)(a)&(m), 2(ix) (k) of the Prevention of Food Adulteration Act,1954 and under the Rules 32(f)&(i) of the Prevention of Food Adulteration Rules, 1955 for selling the adulterated and misbranded “Raja’s Turmeric Powder”. On the complainant side, the following witnesses were examined.
PW-1: Thiru.A.R.Sankaralingam,FoodInspector(who lifted the food sample)

PW-2: Thiru.I.S.Natarajan, Independent witness.
Totally 21 exhibits were marked.

PW-1, in his evidence has clearly deposed regarding his inspection at the place of sampling and lifting the sample from the accused according to the procedures to be complied with and his sending of the same for analysis complying the procedures, filing of chargesheet, & the service of 13(2) notice by the Local Health Authority before this Honourable court.
Now the points for consideration in this case are the following:
The defence counsel has raised untenable contentions regarding the lifting of sample by putting forward an imaginary story. The complainant is strongly objecting the same since the contention of the defence counsel is false & vexatious. The PW-1 has complied all the formalities without any flaw in whatsoever manner.
The next point put forward by the defence counsel at the time of trial was that the PW-2, the independent witness has turned hostile and there is no corroboration to substantiate the evidence of the PW-1. In this aspect, I humbly invite your Honour’s kind attention to the Judgement of the Honourable Supreme court of India (A.I.R.-1992. S.C. 1121) in which the Honourable Supreme Court has viewed that the corroboration of Independent witness is not necessary.
The next point put forward by the defence counsel at the time of trial was that the Form-VI addressed to the manufacturer is not prepared at the place of sampling and that the signature of the independent witness is not obtained on it. It is clearly stated in the complaint lodged and in the deposition of the Food Inspector that the Form-VI was prepared after coming back to the office. Moreover, the Form-VI to the manufacturer marked as Ex-P-3 was sent by Courier Post as the manufacturer is living outside the Corporation limit. The signature of the Independent Witness is obtained on the Form-VI served to the A-1 marked as Ex-P-2, as it was prepared and served to the A-1 in the presence of Independent witness. But it is not possible to obtain the signature of the Independent witness on the Form-VI served by post.
The next point put forward by the defence counsel at the time of trial was that the date put below the signature of the Independent witness is corrected. It is an overwriting done by the Independent witness himself with his own pen and not by anybody else and not a correction of the date as contended by the defence counsel.
The next point put forward by the defence counsel at the time of trial was that the notice under section 13(2) was not served on 06.03.2007. The accused A-1 has signed with date in the copy of the 13(2) notice marked as Ex-P-18 and in the Form-III marked as Ex-P-19. The A-2 has signed with date in the Acknowledgement Card sent along with the Registered Post containing the 13(2) notice and the Form-III report.
It is respectfully submitted that the Hon’ble Madhya Pradesh High High Court in 1992 (2) – FAC Page 232 held that
“ PFA Act, 1954- Section 13 (2) – delay in prosecution – challan was filed 18.11.1967 and the petitioner appeared before the trial Magistrate on 20.12.1967 ie., about 4 ½ months after. But the petitioner never made a demand in the trial Court for examination of the sample bottle with him by the Director of Central Food Laboratory. There being no application for such examination, as contemplated by Section 13(1) of the Act, it is not open to the Petitioner to contest that any prejudice was caused to him by the delay in launching the prosecution”.
The defence counsel has raised untenable contentions regarding the lifting of sample by putting forward an imaginary story. The defence counsel has put forward an imaginary and false story that the Turmeric Powder which was lifted as food sample does not belong to the same Batch. The non-mentioning of the “Batch No.”, “Manufacturing date” and the “Best before date” are the offences committed by the manufacturer and the same has been mentioned in the Form-III report of the Public Analyst. Hence the Food Inspector has collected the food sample of 18 “Raja’s Turmeric Powder” packets from the available 25 packets, which is clearly deposed in the evidence of the PW-1.
The next point put forward by the defence counsel at the time of trial was that the method of analysis has not been mentioned in the Form-III report. The Form-III marked as Ex-P-14 has disclosed the “Name of method of test used” as DGHS manual method.
The next point put forward by the defence counsel at the time of trial was that the quantity of food sample was less than the prescribed in the Rule 22 of the PFA Rules, 1955. S.No.17 in Rule 22 prescribes the approximate quantity to be supplied as 150 grams for spices. The turmeric powder comes under this category and the Food Inspector has lifted 300 grams of “Raja’s Turmeric Powder” per part which is more than sufficient for analysis.
The evidence of the PW-1 from visiting the shop of the accused, lifting the sample, sending the same for analysis to the Public Analyst and subsequently filing the chargesheet and the admission of the signature by the PW-2, clearly proves the complainant’s case.
The Complainant had observed all the mandatory provisions of the PFA Act & Rules and has proved the case beyond all doubts and prays that this Honourable court be pleased to deal with the accused in accordance with law and thus render justice.

COUNTER SUBMITTED BY THE RESPONDENT
1. It is submitted that the petition filed by the petitioners/Accused 3&4 is not maintainable in law nor can it be sustainable on the facts.
2. It is submitted that all the allegations contained in the petition, except those that are specifically admitted hereunder, shall deemed to be denied.
3. The petitioner have prayed to drop the prosecution against them.
4. The above petitioners approached the Honourable High Court of Madras on the same grounds and they were Petitioner No. 2 & 3 in the Crl.O.P.. . . . . of 2003 in which the Honourable High Court, Madras pronounced the following order on 06.03.2003:
“In consideration of the facts pleaded having regard to the materials placed on record and upon hearing the learned counsel for the petitioner and the learned Government Advocate on the Criminal side, this court is of the view that the subject is ripe for trial and it is only desirable to direct the petitioner to approach the trial court to carry on with the trial procedure so as to answer many questions which are raised before this court by both sides which are mostly factual and therefore, this court at this juncture doesnot find any reason to cause its interference and hence the following order:
In result,
(i) the above Criminal Original Petition is disposed off;
(ii) the petitioners are always at liberty to raise preliminary objections testifying the validity of the case on legalities.”
5.The same petitioners again filed a quash petition in Crl.O.P. . . . . 0f 2004 before the Honourable Madurai Bench of Madras High court which was also dismissed by the Honourable High Court Bench on 25.10.2007.
6. Moreover, the petitioners/accused no. 3&4 have been arrayed as accused in the food adulteration case filed in this Court only on the basis of the letter send by the authorized signatory of the . . . . . . Ltd. which has been marked as Exhibit-23 in the above case, when the PW-1, Food Inspector gave his evidence in chief on 21.09.2004.
7. The label of the sample is having the names of RBD Palmolein oil and Palmoil, which are two different oils, and the sample is not plainly and conspicuously labeled so as to indicate its true character as per the PFA Act 1954 and Rules made there under. Thus, the food sample is Misbranded. Hence, the Public Analyst who examined the label of the food sample reported the sample as Misbranded. Based on the report of the Public Analyst, the Food Inspector has arrayed the seller and the manufacturer as accused.
Hence, it is most humbly prayed that this Honourable Court be pleased to dismiss the petition and thus render justice.

Counter filed on behalf of the complainant by the Assistant Public Prosecutor Gr.II to the Petition filed by the petitioner/ accused (A-1) under section 19 (2) of the Prevention of Food Adulteration Act 1954.
1.The petition itself is not maintainable in law or in facts.

2. Para 1 of the petition is admitted.

3. Para 2 of the petition is admitted.

4. Para 3 of the petition is denied. The petitioner/accused (A-1) is running his business at Door No.13/6-B, Perumal Sannathi street, Palayamcottah and not at Palayamcottah as stated in the petition.

5.Para 4 of the petition is not maintainable. The Food sample for analysis was lifted from the custody of the accused No.1. Accused No.2 & 3 are the partners of the Ramsankar Agencies. Accused No.4 is the agency that has sold the misbranded Arokya Milk. So they are necessary parties to this case. Moreover the petitioners/accused has not filed any documentary evidence to invoke Sec.19(2) of the Prevention of Food Adulteration Act and the burden of proof rest upon the petitioners/accused.
6. Para 5 of the petition is not maintainable. Regarding the presence of the petitioners/accused for trial can be decided only after the petitioners/accused prove themselves for eligibility to invoke Sec.19(2) of the Prevention of Food Adulteration Act.

1. It is submitted that the petition filed by the petitioner/Accused 5 is not maintainable in law nor can it be sustainable on the facts.
2. It is submitted that all the allegations contained in the petition, except those that are specifically admitted hereunder, shall deemed to be denied.
3. The petitioner has prayed to drop the prosecution against them.
4. The above petitioner approached the Honourable High Court of Madras on the same grounds and he was Petitioner No. 4 in the Crl.O.P.654 of 2003 in which the Honourable High Court, Madras pronounced the following order on 06.03.2003:
“In consideration of the facts pleaded having regard to the materials placed on record and upon hearing the learned counsel for the petitioner and the learned Government Advocate on the Criminal side, this court is of the view that the subject is ripe for trial and it is only desirable to direct the petitioner to approach the trial court to carry on with the trial procedure so as to answer many questions which are raised before this court by both sides which are mostly factual and therefore, this court at this juncture doesnot find any reason to cause its interference and hence the following order:
In result,
(i) the above Criminal Original Petition is disposed off;
(ii) the petitioners are always at liberty to raise preliminary objections testifying the validity of the case on legalities.”
5. The petitioners 2&3 in the above Crl.O.P.654 of 2003 again filed a quash petition in Crl.O.P.7359 0f 2004 before the Honourable Madurai Bench of Madras High court which was also dismissed by the Honourable High Court Bench on 25.10.2007.
6. Moreover, the petitioner/accused no. 5 has been arrayed as accused in the food adulteration case filed in this Court only on the basis of the letter send by the authorized signatory of the Alagendran Export Ltd. which has been marked as Exhibit-23 in the above case, when the PW-1, Food Inspector gave his evidence in chief on 21.09.2004.
7. The label of the sample is having the names of RBD Palmolein oil and Palmoil, which are two different oils, and the sample is not plainly and conspicuously labeled so as to indicate its true character as per the PFA Act 1954 and Rules made there under. Thus, the food sample is Misbranded. Hence, the Public Analyst who examined the label of the food sample reported the sample as Misbranded. Based on the report of the Public Analyst, the Food Inspector has arrayed the seller and the manufacturer as accused.
Hence, it is most humbly prayed that this Honourable Court be pleased to dismiss the petition and thus render justice.

1954 ம் வருட மத்திய உணவு கலப்பட தடை சட்டத்தின் பிரிவு 13 (2) ன் கீழ் வழங்கப்படும் அறிவிப்பு:
இதனால் தங்களுக்கு அறிவிக்கப்படுவது என்னவென்றால் 25.07.2008 தேதியில் தங்களிடமிருந்து திருநெல்வேலி மாநகராட்சி உணவு ஆய்வாளரால் உணவு மாதிhpயாக எடுக்கப்பட்ட உணவுப் பொருள் பசும்பால் உணவு மாதிரி எண் / உணவு பொதுபகுப்பாய்வாளரால் கலப்படமானது என அறிக்கை செய்யப்பட்டுள்ளது. உணவு பொது பகுப்பாய்வாளாpன் 19.08.2008 தேதிய அறிக்கை எண்.0177ஃ2008-2009 இத்துடன் இணைக்கப்பட்டுள்ளது.
திருநெல்வேலி எண.; 4 குற்றவியல் நீதிமன்றத்தில் தங்கள் மீது 1954 ம் வருட உணவு கலப்பட தடை சட்டத்தின் பிhpவுகள் 7(i),16(1) (a) (i) உ.இ. 2(ia) (a) (m) &7(i), 16(1) (a) (ii) உடன் இணைந்த 1955ம் வருட உணவு கலப்படத் தடை விதி 50(1) ஆகியவற்றின் கீழ் குற்றம் முறையீடு செய்யப்பட்டுள்ளது.
எனவே இந்த அறிவிப்புடன் இணைக்கப்பட்ட பரிசோதனை அறிக்கை கிடைக்கப் பெற்ற பத்து (10) தினங்களுக்குள் இந்த பரிசோதனைஅறிக்கை குறித்து ஏதேனும் ஆட்சேபனை இருந்தால் மத்திய பகுப்பாய்வு கூடத்தின் மூலம்,தங்களிடமிருந்து எடுக்கப்பட்ட உணவு மாதிரியின் இரண்டாவது பாகத்தை பகுப்பாய்வு செய்;வதற்கு ஏற்பாடு செய்து கொள்ள இந்த அறிவிப்பில் குறிப்பிடப்பட்டுள்ள நீதிமன்றத்தில் மனு செய்து கொள்ளுமாறு இதன் மூலம் தங்களுக்கு அறிவிக்கப்படுகிறது.

நீருக்காகப் போர்
“நீரின்றி அமையாது உலகு”- வள்ளுவன் வாக்கு. “நீருக்காகப் போர் ” - இதுவே இன்றைய உலகின் நிலை. நம் பூமியில் 3ல் 4 விழுக்காடு, வானுக்கும்
பூமிக்கும் வடம் பிடிக்கும் வெள்ளி அருவி , துள்ளிவரும் பேராறு, பரந்த நீர் நிலைகள் தரும் நீரால் நிறைந்துள்ளது. இப்படி தாராளமாய்க் கிடைக்கும் நீர் குடிப்பதற்கு ஏற்றதுதானா? சிந்திப்போமா சில நிமிடம்!
ஆறு குளங்களிலுள்ள நீர் அப்படியே குடிப்பதற்கு ஏற்றதல்ல. அவற்றில் பல வகையான அசுத்தங்கள் கலந்திருக்கும். நம் கண்ணிற்குத் தெரிபவை சில. தெரியாதவை பல. தண்ணீரில் மிதக்கும் தூசிகள் , கரைந்திருக்கும் மண் படிவங்கள், கழிவுகள் இவையே நீரைக் கலங்கலாக்கும் காரணிகள். இவை தவிர, மண்ணிலுள்ள தாதுக்கள் தண்ணீரில் கரைந்திருக்கும். அவை தண்ணீருக்குச் சுவையளிக்கும். இந்நீரை அப்படியே பருகினால் நீரினால் பரவும் நோய்கள் நம்மைத் தாக்கும்.எனவேதான், ஆறு குளங்களிலிருந்து கிடைக்கும் நீரைப் பல நிலைகளில் சுத்திகரித்து அதைக் குடிப்பதற்கு ஏற்ற குடிநீராய் மாற்றி, குளோரின் வாயு ஏற்றி, கிருமிநாசம் செய்து, உள்ளாட்சி நிறுவனங்கள் பொதுமக்களுக்கு விநியோகிக்கின்றன.
இது இவ்வாறிருக்க, இன்றோ பயணம் செய்யும் பலர் கையிலும் பாட்டில் குடிநீர்.

நாம் வாங்கும் ஒவ்வொரு குடிநீர் பாட்டிலில் பாக்கட்டில் இருக்க வேண்டிய அடிப்படை அம்சங்கள் என்னென்ன என பாப்போம். தயாரிப்பு தேதி பேட்ச் எண் ஐ.எஸ்.ஐ. தர முத்திரை தயாரிப்பாளரின் முழு விலாசம். எந்த தேதி வரை பயன்படுத்த உகந்ததுஇவையனைத்தும் இருந்தாலும், தரத்தை நிர்ணயிக்கும் 51 வகையான பரிசோதனைகளில் தேர்வு பெறுபவை மிகச்சில தயாரிப்புகளே. இவற்றில் ஏதேனும் குறைபாடு கண்டறியப்பட்டால், அது குறித்து, உடனடியாக சம்பந்தப்பட்ட பகுதிக்கு உரிய உள்ளாட்சி நிறுவனத்திலோ, சுகாதாரத்துறையிலோ, ஐ.எஸ்.ஐ. தரச்சான்று வழங்கும் பி;.ஐ.எஸ். நிறுவனத்திலோ புகார் செய்யலாம். மேலும், பாக்கட்டில் / பாட்டிலில் அடைத்து குடிநீர் தயாரிக்கும் நிறுவனம் ஐ.எஸ்.ஐ. தரச்சான்று பெற்றுள்ளதா? அந்த சான்று எந்த தேதிவரை பயன்படுத்த அந்த நிறுவனத்திற்கு உரிமம் வழங்கப்பட்டுள்ளது போன்ற விபரங்களை பி;.ஐ.எஸ். நிறுவனத்தின் இணைய தளத்திலும் பார்த்து தெரிந்து கொள்ளலாம்.நிலத்தடி நீரை ஆழ்துளை குழாய்கள் மூலம் வெளியில் எடுத்து, அந்நீரை சுத்தப்படுத்தி, வடிகட்டி பாக்கட்டில் / பாட்டிலில் அடைத்து விற்பதில்தான் வருகிறது மனிதனின் பேராசை.நாளுக்கு நாள் பெருகி வரும் குடிநீர் தேவையை கருத்தில் கொண்டு, பெரிய நிறுவனங்கள் நிலத்தடி நீரை மேலும் மேலும் உறிஞ்சுகின்றன. இது நிலத்தடி நீர் மட்டத்தை வெகு கீழே கொண்டு செல்கிறது. இனி, வீடுகளில் ஆழ்துளைக் கிணறு அமைக்க பூமிக்குள் பல மைல் தூரம் பயணப்படவேண்டியதிருக்கும். இதுவே, நீருக்கான போருக்கு வித்திட்டுவிடும்.

It is submitted that on 12.08.2008 at about 05.30 P.M, the respondent purchased three packets of RBD Palmolein Oil from the shop of the first accused namely . . . . . . . . . . . . . . grocery Stores at Panpari market, Tirupapuliyur after serving Form-VI notice and the Food Inspector paid Rs.165 /-(One hundred and sixty five only) and obtained a cash receipt. The Second accused is the Proprietor of the . . . . . . . . . . . . . . Agencies, which distributed the adulterated Palmolein Oil. The third accused/Petitioner is the Proprietor of the . . . . . . . . . . . . . .Foods situated at No. ,Sanyasi kuppam Road, Thirubuvanai which manufactured the . . . . . . . . . . . . . .Imported RBD Palmolein Oil.The Food Inspector has divided the three pre-packed packets into three equal parts. The Food Inspector sent one part to the Public Analyst and sent the remaining two parts to the Local Health Authority. The Public Analyst sent a report to the Local Health Authority.
4. It is submitted that the Public Analyst report revealed that “the sample is found to be adulterated”.

It is submitted that the respondent collected the material documents and facts and sent the necessary proposals to the concerned officer for obtaining written consent on 19.03.2009.The Joint – Director (PFA) , Chennai accorded necessary consent on 18.05.2009 to the Food Inspector for launching prosecution against all accused U/s.16(i)(a)(i) r/w 7(i),2(ia)(a)(m) of the PFA Act,1954. Accordingly, the case was filed on 25.08.2009.
6. It is most humbly submitted that the Respondent/Complainant denies the Para a , b&f of the grounds in the Petition filed by the Petitioner 3. There is no delay in filing the complaint. The food sample of . . . . . . . . . . . . . .Imported RBD PalmoleinOil was taken on 12.08.2008. After receiving the Public Analyst’s analysis report in Form-3 on 04.09.08, as the sample was found to be adulterated, the Food Inspector wrote to the manufacturer to disclose the ownership details of manufacturer on 12.09.2008. The manufacturer, namely the Petitioner 3, disclosed the details of the manufacturer only on 14.03.2009. Thereafter the Respondent/Complainant obtained written consent from the Prosecution sanctioning authorities and filed the complaint on 25.08.09. A notice U/s.13(2) of the Prevention of Food Adulteration Act,1954 to all the accused to have the II portion of the food sample analyzed by the Director of Central Food Laboratory. None of the accused including the Petitioner/accused No.3 opted for sending the II portion of the food sample to be analyzed by the Director of Central Food Laboratory. When there being no application for such examination, as contemplated by Sec.13(1) of the Act, it is not open to the petitioner to contend that any prejudice was caused to him.

So the delay in launching prosecution has not caused any prejudice to the accused.
7. It is most humbly submitted that the Respondent/Complainant denies the Para C of the grounds in Petition filed by the Petitioner 3. The Food Inspector has complied the Rule 17(b) and 22-A of the Prevention of Food Adulteration Rules, 1955. In para-3 in page -3 of the history of offence submitted along with the chargesheet filed in the trial court, the Complainant Food Inspector has stated that

This amounts to compliance of Rule 17(b).

In the same way, the Complainant has taken three numbers of one litre RBD Palmolein oil packets out of the 10 litres available in the grocery shop. This amounts to compliance of Rule 22-A.

It is most humbly submitted that the Petitioner/Accused No.3 admits in Para-C of the grounds in his Petition that the Acid value for the food sample sent for analysis was 0.9 Bis which was over and above the permitted volume of acid value. Hence, his contention that the foundation for launching the prosecution no longer exists and prosecution has to be quashed is not maintainable.
9. It is most humbly submitted that the Respondent/Complainant denies the Para e of the grounds in the Petition filed by the Petitioner 3. The manufacturer namely the Petitioner/accused no.3 in this case has been arrayed as accused u/s.7 of the Prevention of Food Adulteration Act, 1954 and not U/s.20-A. Hence, the contention of the petitioner that the manufacturer can be implicated or prosecuted only after the commencement of the trial or only after taking evidence is not sustainable. Because, the Honourable Apex Court has opined in the para-C of the BhagawanDas Jagdish Chander Vs Delhi Administration in 1975 SCC (Cri)410 that Distributor or manufacturer can be joined as co-accused initially.
10. It is most humbly submitted that the Respondent/Complainant denies the Para g of the grounds in the Petition filed by the Petitioner 3. As per Sec.13(2) of the Prevention of Food Adulteration Act,1954, the Local Health Authority has to serve the notice under the above section only after the institution of prosecution. It has been held in 1987 L.W.(Crl)342 in Abdul Azeez Vs Food Inspector, Ulundurpet that ‘Institution’ of the prosecution being the date on which the complaint was taken on file by the Magistrate. Here, in this case also, the complainant has taken steps to serve the 13(2) notice after the case was taken on file on 07.09.2009. Hence, the contention that the 13(2) notice was served beyond 10 days after the institution of prosecution is not sustainable.
Hence it is most humbly prayed that this Honourable Court may be pleased to dismiss the Crl.O.P. 23980 of 2009 with Cost.
